البابا كيرلس الرابع أبوالإصلاح وقانون الأحوال الشخصية
فى عام
1867 خاطبت وزارة الحقانية البطريرك كيرلس الرابع أبوالإصلاح عن أسباب الطلاق فى المسيحية فكلف الأيجومانس (القمص) فيلوثأوس عوض بإعداد لائحة، وبعد أن انتهى من اعتمدها البابا كيرلس الرابع وقدمها للوزارة.

فماذا فعل الأيجومانس فيلوثأوس عوض والذى دعاه قداسة البابا شنودة فى جريدة وطنى الصادرة الأحد
23/8/1987 قائلا: إنه أستاذ أستاذى ويقصد بأستاذه حبيب جرجس.

لقد قام القمص فيلوثأوس بالعودة إلى كتاب المجموع الصفوى الذى يتضمن القوانين التى جمعها العلامة الشيخ الصفى أبى الفضائل ابن العسال فى القرن الثالث عشر وبنى عليه ما سماه الخلاصة القانونية فى الأحوال الشخصية لكنيسة الأقباط الأرثوذكسيين، وقد جمع كل ذلك ابن فيلوثأوس ويدعى جرجس فيلوثأوس عوض ووضع ملحقات له كانت الطبعة الأولى عام
1896 والثانية 1913 والأخيرة 1933م، وهو ما نعتمد عليه فى بحثنا هذا.

يقول فى المادة
18 الأحوال الشخصية (الطلاق وفسخ الزيجة): «فى الدين المسيحى لا يوجد طلاق بل فسخ زيجة المتزوجين والتفريق بينهما ليصح للمؤمن منهما أن يتزوج بمن يريد الرب فقط».

أسباب فسخ الزيجة

1
ــ الموت حقيقة أو حكما أو تقديرا

2
ــ الزنى حقيقة أو حكما أو تقديرا

فالموت حقيقة هو مفارقة النفس العاقلة للجسم الترابى، ولو قتلا، من لم يمت بالسيف مات بغيره تعددت الأسباب والموت واحد، أما الموت حكما فهو الحكم بإلحاقة بالموتى كما فى المفقود أو كمن حكم عليه جنائيا بالموت أو النفى أو السجن المؤبد أو أخذ فى الأسر وحكم بأنه لا يعيش أكثر من هذه المدة أو نفته الكنيسة من شركتها وقطعته واعتبرته مائتا من عضويتها سواء كان لتغييره دينه أو لعدم إطاعته لأوامر الكتاب والسير حسبما تقضى الأوامر من حسن المعاشرة والقيام بما يجب عليه حال قيام الزوجية
.

وأيضا إذا غاب أحد الزوجين عن وطنه بالأسر أو بغيره بحيث لا يعلم مقره ولا حياته من عدمها واستمر أمره هكذا مجهولا من خمس سنوات إلى سبع سنوات، ولم يحتمل قرينه الانتظار أكثر من ذلك ويرغب بعد مضى هذه المدة بالتصريح له بالزواج فيجاب إلى ذلك، بشرط أن يتحقق لدى الرئيس الشرعى غياب الزوج الآخر سبع سنين أو أقله خمس ولم يظهر له خبر كل هذه المدة ولم يكن لقرينه احتمال أو رغبة فى الانتظار أكثر
.

إما إذا كانت حياة الغائب أو الأسير محققة غير مشكوك فيها ومقره معلوما فلا يفسخ الزواج اللهم إلا إن طالت المدة، أعنى تجاوزت السنوات السبع، و إذا ثبت أن الغائب قد تزوج، أو كان الغائب هو الرجل ولم يبعث لامرأته النفقة وتشكى الفريق الآخر من ذلك، فللرئيس الروحى تدبير أمره من جهة الزواج، حسبما تستدعيه حالته مما لا يضاد الشرع
.
وبالطبع لو الطرف الثاني الغائب تزوج فهو زاني فيحق للاول ان يطلق


وكذلك إذا حكم على أحدهم بحكم جنائى وجب إبعاده عن وطنه أو إقليمه، فإن كانت مدة الحكم لا تزيد على سبع سنوات فالزواج باق وانتظرت عودته، وإن كانت تزيد على ذلك زيادة لا يتحملها قرينه أو كان الحكم توقع بالإبعاد مدة عمره بحيث لا ترجى عودته، فالخيار لقرينه أن شاء الزواج بآخر يصرح له بذلك بعد ثبوت الموجب، والنتيجة أن يعتبر فى حالة الغائب المجهول أمره أو المعلوم مدة من خمس سنوات إلى سبع، ومتى عبرت ولم يطق قرينه الاحتمال ورغب الاتصال فللرئيس الروحى إجابته، وذلك بالتطبيق لما ورد بالعدد الثالث من التطاوس
(البند) الحادى عشر وما ورد فى القانون الكيرلسى، ونصه: إن الكتاب المقدس يقول صراحة إن المرأة مرتبطة بالرجل مادام حيا. فإن ثبت موته ولو حكما ترخص للباقى بالزيجة، أما إذا ثبت بقاء الغائب على قيد الحياة انتظره الآخر حتى يعود.
اي ان الحكم بالسجن فوق السبع سنين لا يكفي كسبب للطلاق


وعليه يكون فسخ الزيجة بموجب هذه الأسباب محتما وما يسرى على الرجل يسرى على المرأة
:
أــ الموت حقيقة
.
ب ــ تغيير الدين لا المذهب، واعتبار العضو الشارد ميتا حكما عن كنيسته
.
جـ ــ النفى المؤبد الذى لا يرتجى أن يعود منه
.
د ــ السجن المؤبد الذى لا يرتجى الخلاص منه
.
هـ ــ الحكم بالإعدام ولو طال الأمد
.
وــ المنافرة وعدم الخضوع للأوامر الإلهية والخروج عن الحد واعتبار العضو النافر ناشزا فى حكم الميت عن كنيسته
. حيث يضر بنظام الزواج كوقوع الشر والخصام المتواصلين المؤذيين من أحد الزوجين للآخر ظلما، أو كمانعة أحدهم للآخر فى استيفاء حقوقه الشرعية التى له على قرينه، أو توبيخه أو تأديبه على ما تقتضيه الحال إلى أن يصطلحا ويتفقا فى عش الزوجية، وإذا كان الخلاف واقعا من الفريقين معا ويرى الرئيس أنهما مشتركان فى التعدى فليؤدبهما الأب الروحى حتى يتوبا وينصلح أمرهما.

( ينادي بالتاديب وليس بالطلاق او الفسخ )

أما إذا كان الخلاف صادرا من أحدهما دون الآخر ولم يكف المخالف عن فعله لا بالنصح ولا بالتوبيخ ولا بالتأديب الروحى، وثبت للرئيس امتناعه عن قرينه وانحرام هذا القرين من حقوقه الشرعية الزوجية، واستمر الفريقان منفصلين عن بعضهما وتوسط الكهنة ورئيس الكهنة فى ذلك ولم يهتد المفترى منهما ويرجع عن شره، ورغب المظلوم حله من رباط الزيجة، وترجح بالنظر الدقيق أنه لا وسيلة لامتزاجهما ثانية، فحينئذ للرئيس الروحى أن يجرى ما صرح به القانون ونصه
: إن ما جرى بينه وبين زوجته شر وكانت هى الظالمة، فليصبر عليها ويرفق حتى يصلح أمرها، وإن لم يطق وتفاقم شرها فليتوسط بينهما القسيس الكبير، وإن لم تطع فليتوسط الأسقف مرة واثنتين، وإن لم تطع فليتبرأ الأسقف منها، ومباح للرجل إن أراد الترهب أو العزوبية فله ذلك، وإن لم يكن قادرا ورغب الزواج فله ذلك. أما إن كان الرجل هو الظالم لزوجته ويطلب إقامة الشر معها لكى يفارقها، فلا يقبل منه ذلك ويجبر على مصالحتها، وإن خالف ذلك فليمتنع من شركة السرائر ودخول الكنيسة حتى يتوب.
( ولا يجوز ايضا الطلاق في هذه الحاله )


الزنى أو الفسق

أــ الزنى حقيقة وأسباب حصوله
.
ب ــ مبيت المرأة فى بيت غير بيت أهلها، إلا إذا كان الرجل هو المتسبب فى ذلك بأن أخرجها ليلا ولم يكن أحد من أهلها قريبا لها فباتت فى بيت أجنبى
.
جـ ــ ذهاب المرأة إلى محال الفجور والمواخير والحال التى لا يؤمن فيها على عفتها متى كان ذهابها بمفردها، فما أن أصبح زوجها معها سواء كانت عارفة أو غير عارفة فالتبعة على الزوج
.
دــ سكر المرأة مع الأجانب ومؤاكلتهم إلا إذا كان برضى زوجها واطلاعه
.
هـ ــ وجودها مع أجنبى فى محل خصيصا بها ولم يكن معهما أحد
.

ــ وما يلحق بذلك
:
أــ تدبير أحد الزوجين على حياة وعفة الآخر
.
بــ اشتراك أحدهما فى المؤامرات السياسية أو مع قطاع الطريق
.
جـــ انضمام الرجل إلى فئة المؤنثين أو السكيرين واعتباره مفروزا من الكنيسة
.
دــ الأسباب التى توجب عدم الزواج كالإمراض القاطعة والعنة والخصاء، إذا عقد مع وجودها، أو حدثت بعده فسخ الزواج لعدم وقوع الآخر فيما لا يرجوه، والسبب فى التشديد على المرأة أكثر من الرجل لحدوث جرائم كثيرة من وراء الزنى إن لم يكن القتل وعلى الأقل حرمان النسل الحقيقى من الإرث وتحويله إلى غير مستحقه فضلا عما تصاب به من الأمراض الكثيرة ولذلك كان التشديد على المرأة كثيرا
.
ملحوظه هامه هو الامراض التي تحدث قبل الزواج ويكون الزواج مبني علي باطل وايضا التي تحدث اثناء الفسخ فيكون رجوعهم مره اخري مبني علي باطل )


لائحة
1938:
لم تخرج لائحة
38 عن لائحة 1867 للبابا كيرلس الرابع أبوالإصلاح ونصها نجده فى مجموعة 1955 التالية، وهى المجموعة التى تقدم بها المجلس المللى لوزارة العدل تمهيدا لإصدارها كقانون يطبق نصوصه على الأقباط الأرثوذكس بعد صدور القانون 462 لسنة 1955 بإلغاء المجالس الملية، ولكن نصوص هذه المجموعة لم يأخذ بها القضاء بل أخذ بنصوص مجموعة 1938، وأيدت محكمة النقض والإبرام فى أحكامها هذا الاتجاه وقد حصرت هذه المجموعة أحكام التطليق فيما يلى:
1
ــ يجوز لكلا الزوجين أن يطلب الطلاق لعلة الزنى
.
2
ــ ينفسخ الزواج إذا خرج أحد الزوجين عن الدين المسيحى
.
3
ــ إذا غاب أحد الزوجين
5 سنوات متوالية بحيث لا يعلم مقره ولا يعلم حياته من وفاته وصدر حكم بإثبات غيبته جاز للزوج الآخر أن يطلب الطلاق.

ــ الحكم على أحد الزوجين بعقوبة الأشغال الشاقة والسجن لمدة تزيد على سبع سنوات فأكثر يسوغ للزوج الآخر طلب الطلاق
.

5ــ إذا أصيب أحد الزوجين بجنون مطبق يجوز للزوج الآخر أن يطلب الطلاق إذا كان قد مضى خمس سنوات على الجنون وثبت أنه غير قابل للشفاء.

ويجوز للزوجة أن تطلب الطلاق إذا أصيب زوجها بمرض العنه وثبت انه غير قابل للشفاء، وكانت الزوجة فى سن يخشى عليها فيه من الفتنة، ولم يكن قد مضى على الزواج 5 سنوات.


6ــ إذا اعتدى أحد الزوجين على الآخر وإذا اعتاد إيذاءه إيذاء جسيما يعرض حياته أو صحته للخطر جاز للمجنى عليه أن يطلب الطلاق.


ملحوظه ان بند 4 و 5 و 6 غير موجودين في قرار 1867

وهي لها كماله بها امور اصعب من ذلك وفي نهاية الملف نصها بالكامل

فمن يقول ان لائحة 38 تتطابق مع 1867 هذا غير دقيق لان نصف قرارات 38 زايده لا تتفق مع 67 ولا مع اعداد الانجيل




إلا أن المحكمة عادت إلى قصر التطليق على علة الزنى، عدم زواج المطلقين، وذلك بالقرار الباباوى رقم
7 18 ــ 11 ــ1971.
ملحوظه عدم زواج المطلقين فقط لمن زني فقط اما الطرف الاخر المجني عليه فله ان يتزوج


ونص القرار
:
1
ــ عملا بوصية الرب فى الإنجيل المقدس لا يجوز التطليق إلا لعلة الزنى فقد ورد فيها تعليم السيد المسيح ــ له المجد ــ فى عظته على الجبل قوله
: «وأما أنا فأقول من طلق امرأته إلا لعلة الزنى يجعلها تزنى» (إنجيل متى 5:22)، وقد كرر الرب إجابته هذه على الفريسيين إذ قال لهم: «أقول لكم إن من طلق إمرأته إلا لعلة الزنى وتزوج بأخرى يزنى» (إنجيل متى 19:11)، و«من طلق امرأته وتزوج بأخرى يزنى عليها» (إنجيل مرقس 10:11).

ــ كل طلاق يحدث لغير هذه العلة الواحدة لا تعترف به الكنيسة المقدسة وتعتبر إن الزواج الذى حاول هذا الطلاق أن يفصله لايزال قائما
.

والقرار الباباوى رقم
8 والخاص بعدم زواج المطلقات ونصه:
1
ــ لا يجوز زواج المطلقة عملا بوصية السيد المسيح له المجد فى الإنجيل المقدس إذ قال فى عظته على الجبل
: «ومن يتزوج مطلقة فهو يزنى» إنجيل متى 5:32، وقد كرر الرب نفس الوصية فى حديثه مع الفريسيين إذ قال لهم: والذى يتزوج بمطلقة يزنى (متى 19:9)، وقد ورد فى إنجيل القديس لوقا قول الرب: «وكل من يتزوج بمطلقة رجل يزنى» إنجيل لوقا 16:18. وورد فى إنجيل القديس مرقس: «وإن طلقت امرأة زوجها وتزوجت بآخر تزنى» مرقس 10:12.

والمرأة المطلقة إما أنها طلقت بسبب زناها، أو لسبب آخر غير الزنى، فإن كانت قد طلقت بسبب زناها فإن الإنجيل المقدس لا يسمح لها بالزواج مرة ثانية بحسب النصوص المقدسة التى أوردناها، إذ إن هذه المرأة لا يمكن أن تؤتمن على زواج جديد، أما إن كانت قد طلقت لسبب غير الزنى، فإن هذا الطلاق يعتبر باطلا بسبب وصية الرب فى الإنجيل، ويكون الزواج الذى حاول الطلاق أن يفصمه لا يزال قائما، فأن تزوجت تكون قد جمعت بين زوجين وتعتبر زانية بحسب وصية الرب
.

ــ إنما إن حدث التطليق بسبب زنى الزوج فإن المرأة البريئة من حقها أن تتزوج ويدخل فى نطاق زنى الزوج زواجه بامرأة أخرى
.

ــ لا يجوز لأى من رجال الكهنوت فى كنيستنا المقدسة أن يعقد زواجا لمطلقة إما أن يرفضه أو يعرض الأمر علينا لتحويله إلى المجلس الإكليريكى العام فينظره المجلس الأعلى للأحوال الشخصية
.


القرار البابوي يتطابق مع روح الانجيل


ملاحظات أخيرة
: بعد هذا البحث المطول علينا أن نلاحظ ما يلى:
أولا
: أن تشويه لائحة 1938 على أساس أن الذى أقرها علمانيون وأن البابا يؤانس الذى وضعت فى عهده كان ضعيفا وفرضت عليه اللائحة، وغير ذلك مما سمعناه وقرأناه ليس دقيقا، لأنه تبين أن لائحة 38 جاءت معتمدة أساسا على لائحة 1867م التى أعدها القمص فيلوثاؤس عوض، واعتمدها البابا كيرلس الرابع أبوالإصلاح، والتى اعتمدت على المجموع الصفوى للشيخ ابن العسال من القرن الثالث عشر، الذى اعتمد بدوره على تاريخ طويل بدءا من القرن الأول.

هذا غير دقيق لان بند 4 و 5 و 6 غير موجودين في لائحة 1867



ثانيا
: إنه على طول التاريخ، اعتبرت الكنيسة الموت الحكمى سببا فى الطلاق، وهو الغياب من خمس لسبع سنوات دون معرفة المصير لأحد الزوجين، أو إذا حكم على أحد الطرفين بالسجن بالأشغال الشاقة أو السجن أو الحبس لمدة سبع سنوات، أو إذا أصيب احد الزوجين بجنون مطبق أو مرض معد يخشى منه على سلامة الآخر على أن يطلب الطلاق الطرف المتضرر بعد مرور ثلاث سنوات على المرض، أو إذا اعتدى أحد الزوجين على حياة الآخر واعتاد إيذاءه إيذاء جسيما يعرض صحته للخطر، أو الفرقة لمدة ثلاث سنوات.

مع العزر هذا ايضا غير دقيق فتغيب الطرف الثاني سبع سنين مع عدم سماع اي اخبار منه وبهذا يتاكد الطرف الاول ان الطرف الثاني ميت حكميا ولكن السجن اكثر من سبع سنين والعلم بانه حي لا يجوز بسببه الطلاق حسب قرار 1867 وبالطبع نص الانجيل

في روميه 7

2 فَإِنَّ الْمَرْأَةَ الَّتِي تَحْتَ رَجُل هِيَ مُرْتَبِطَةٌ بِالنَّامُوسِ بِالرَّجُلِ الْحَيِّ. وَلكِنْ إِنْ مَاتَ الرَّجُلُ فَقَدْ تَحَرَّرَتْ مِنْ نَامُوسِ الرَّجُلِ.
3 فَإِذًا مَا دَامَ الرَّجُلُ حَيًّا تُدْعَى زَانِيَةً إِنْ صَارَتْ لِرَجُل آخَرَ
. وَلكِنْ إِنْ مَاتَ الرَّجُلُ فَهِيَ حُرَّةٌ مِنَ النَّامُوسِ، حَتَّى إِنَّهَا لَيْسَتْ زَانِيَةً إِنْ صَارَتْ لِرَجُل آخَرَ.


ثالثا
: أيضا اعترفت الكنيسة بالزنى الحكمى على طول تاريخها
الانجيل لم يتكلم عن الزني الحكمي وتكلم العهد القديم عن ماء اللعنه للغيره فقط ولكن الزني الحكمي يحكم عليه الان بطرق اسهل من الاول فتحديد الزني اسهل بكثير ولا حاجه الان الي موضوع الزني الحكمي


رابعا
: إن القول بأن السيد المسيح قال إن لا طلاق إلا لعلة الزنى وأن من يتزوج بمطلقة يزن.. إلخ تماما مثل القول لا تقربوا الصلاة، لا يوجد نص يقول لا طلاق إلا لعلة الزنى لكنه يقول إن من طلق امرأته إلا لعلة الزنى يجعلها تزنى، ومن يتزوج مطلقة فإنه يزنى متى 5:31 ولكن هذا النص يتضح ويفسره المسيح فى نفس الإنجيل فى الإصحاح 19 إذ يقول إنجيل متى وجاء إليه الفريسيين ليجربوه (يسوع المسيح) قائلين له هل يحل لرجل أن يطلق امرأته لكل سبب؟ وكان هذا السؤال لان الرجل اليهودى كان يطلق امرأته بالإرادة المنفردة لكل سبب وأى سبب، لذلك كان السؤال عن الطلاق بالإرادة المنفردة للرجل، وكانت إجابة السيد المسيح: «من طلق امرأته إلا بسبب الزنى وتزوج بأخرى يزن»، والرد هنا إن ليس على الرجل أن يطلق امرأته بالإرادة المنفردة إلا إذا وجدها متلبسة بالزنى، أما الطلاق لأسباب أخرى فلابد من الحوار مع الزوجة، وهذه إجابة السؤال.
في رايي هذا تعليق غير دقيق وكلمات رب المجد واضحه واكرر العدد يقول في متي 5 32

إنجيل متى 5: 32


وَأَمَّا أَنَا فَأَقُولُ لَكُمْ: إِنَّ مَنْ طَلَّقَ امْرَأَتَهُ إلاَّ لِعِلَّةِ الزِّنَى يَجْعَلُهَا تَزْنِي، وَمَنْ يَتَزَوَّجُ مُطَلَّقَةً فَإِنَّهُ يَزْنِي.



فاي سبب اخر للطلاق الا لعلة الزني يجعل زوجته تزني فمن يقول ان الاسباب الاخري تحتاج لحوار هذا لا يتكلم بالنص الكتابي

وبهذا يكون وجود انسان مطلقه او انسان مطلق هو بسبب انها زنت فقط ولهذا من يتزوجها يزني

ولو كان يقصد الموت الحكمي فهذا لا يوجد فيه حوار لان الانسان في حكم ميت

فاعتقد استطيع ان اقول ان هذا التعليق من كات المقال مع كل احترام لشخصه تعليق مرفوض


وقال لهم
: إنه من البدء خلقهما ذكرا وأنثى، وإن ما جمعه الله لا يفرقه إنسان، قالوا له: فلماذا أوصى موسى أن يعطى كتاب طلاق فتطلق؟ قال لهم: إن موسى من أجل قساوة قلوبكم إذن لكم أن تطلقوا نساءكم، ولكن من البدء لم يكن هكذا. لم يقل المسيح إن موسى أخطأ، لكنه قبل الطلاق إذا توافرت قساوة القلب وهذا الذى ترجمه القمص فيلثاؤس بعمل الشر للآخر وإيذائه، وترجمته لائحة 38 باستحالة العشرة، أما عن الزواج الثانى فقد قال السيد المسيح تكملة للحوار: إن المطلق الذى يتزوج بأخرى يزنى والذى يتزوج بمطلقة يزنى، قال له تلاميذه: إن كان هذا أمر الرجل مع المرأة فلا يوافق إن تزوج فقال لهم: ليس الجميع يقبلون هذا الكلام. أى هناك من يرفضه لأنه صعب بالنسبة له، والسيد المسيح يقبل الاثنين، من يقبل ومن يرفض.

تعليقي علي نقطتين

اولا القمص فيلثاؤس لم يقل ان ايذاء الاخر يحكم فيه بالتطليق ولكن يحكم فيه بالعقوبه الكنسيه ولم يتكلم عن التطليق اما ما قله قرار 38 باستحالة العشره فهذا كتابيا مرفوض

ثانيا المسيح يقبل من قبل ومن رفض هذا مبدا غريب علي اذني ولم يوجد في الكتاب والكتاب في موضوع من يقبل ومن يرفض يتكلم عن الرهبنه وليس عن التطليق فبهذا استخدامه كتفسير هو غير دقيق

وللتاكيد متي 19

9 وَأَقُولُ لَكُمْ: إِنَّ مَنْ طَلَّقَ امْرَأَتَهُ إِلاَّ بِسَبَب الزِّنَا وَتَزَوَّجَ بِأُخْرَى يَزْنِي، وَالَّذِي يَتَزَوَّجُ بِمُطَلَّقَةٍ يَزْنِي».
10 قَالَ لَهُ تَلاَمِيذُهُ
: «إِنْ كَانَ هكَذَا أَمْرُ الرَّجُلِ مَعَ الْمَرْأَةِ، فَلاَ يُوافِقُ أَنْ يَتَزَوَّجَ
11 فَقَالَ لَهُمْ
: «لَيْسَ الْجَمِيعُ يَقْبَلُونَ هذَا الْكَلاَمَ بَلِ الَّذِينَ أُعْطِيَ لَهُم،
12 لأَنَّهُ يُوجَدُ خِصْيَانٌ وُلِدُوا هكَذَا مِنْ بُطُونِ أُمَّهَاتِهِمْ، وَيُوجَدُ خِصْيَانٌ خَصَاهُمُ النَّاسُ، وَيُوجَدُ خِصْيَانٌ خَصَوْا أَنْفُسَهُمْ لأَجْلِ مَلَكُوتِ السَّمَاوَاتِ
. مَنِ اسْتَطَاعَ أَنْ يَقْبَلَ فَلْيَقْبَلْ».

ثم قال السيد المسيح
: من ينظر لامرأة ليشتهيها فقد زنى بها فى قلبه، وإذا طبقنا حرفيا هذه الكلمات يصبح الطلاق فى المسيحية سهلا جدا.
مع الاعتزار مره اخري هذا تفسير حرفي للعدد فالسيد المسيح يتكلم عن طهارة القلب لان بهذا المقياس الذي قاله صاحب المقال مع كل احترام فيجب ايضا ليس ان يطلق فقط بل ان يطبق العدد التالي ( 29 ) ويقلع عينه فهل يقبل كاتب المقال ان يطبق ذلك حرفيا ؟ وايضا فيجب ان نقطع انفسنا من الشعب مع كل فكره شريره ولو صغيره . بالطبع العدد لا يؤخد حرفيا والا اصبحنا مثل اوريجانوس


خامسا
: إن هناك مبدأ أساسيا فى المسيحية يجب كل المبادئ الأخرى هو الغفران، ولقد قال السيد المسيح لتلاميذه ومنهم الرسل بطرس ويوحنا ويعقوب: ما تربطونه فى الأرض يكون مربوطا فى السماء وما تحلونه فى الأرض يكون محلولا فى السماء. وقال لهم أيضا: صلوا قائلين: وأغفر لنا ذنوبنا كما نغفر نحن أيضا للمذنبين إلينا، وأردف: لأنه إن لم تغفروا للناس زلاتهم لن يغفر لكم أبوكم السماوى زلاتكم، أى لا توجد خطيئة بلا غفران مدى العمر، وإذا رفض التلاميذ أن يغفروا للناس لن يغفر الله لهم.
هذا اتفق معه في مغفرة الزوجين لبعضهما البعض وليس في خطية الزني

وكما اوضحت في ملف الطلاق في اليهودية والمسيحيه ان معني كلمة طلاق في العبري هي قطع لحم فمن مسك سكين بيده اليمني وقطع يده الاخري لانه يتلذذ برؤية الدم فهل لو ندم وتاب توبه حقيقيه فهل بمغفرة ذلك تعود يده المقطوعه ؟ توبته مقبوله ولكن يده لن تعود

فمن زني كمن مسك سكين وقطع نصف جسده حتي لو تاب ممكن توبته تكون مقبوله امام الله ويغفر له بالفعل ولكن هو اصبح نصف جسد مقطوع بالنسبه للتي كانت زوجته


سادسا
: لقد فرق الأنبا جرجوريوس بين الطلاق والتطليق كما جاء فى كتاب شريعة الزوجة الواحدة تأليف قداسة البابا شنودة، ويقول الأنبا جرجوريوس أسقف التعليم إنه لا طلاق فى المسيحية لكن يوجد تطليق، والتطليق يسمح بالموت الحكمى والزنى الحكمى.. إلخ
وايضا هذا مقبول للكنيسه وقصد التطليق بالموت والزني الحكمي سابقا ولكن الان سهل اثبات الزني ولا حاجه لامر الزني الحكمي


سابعا
: لم يحدث فى التاريخ أن طلب أحد الباباوات من الدولة أن يقتصر طلاق المسيحى على علة الزنى فقط، وأن يُرفض الزواج الثانى إلى الأبد، فما يحدث ألان يتم لأول مرة منذ ألفى عام.
هذا كلام غير صحيح مع الاعتزار فاكتفي فقط بقرار 1867 الذي تقد صاحب القرار ووضع نصه كامل يشهد بذلك والانجيل يشهد بذلك واقوال الاباء مثل يوحنا ذهبي الفم والقديس اغسطينوس وغيرهم

وتعليق القديس اغسطينوس

عدم تطليق الزوجة باستهتار - جعل الاستثناء الوحيد هو علّة الزنا. فقد أمر بضرورة احتمال جميع المتاعب الأخرى بثبات من أجل المحبّة الزوجيّة ولأجل العفّة، وقد أكّد رب المجد نفس المبدأ بدعوته من يتزوج بمطلّقة "زانيًا

ويقول ايضا لايجوز لرجل ان يترك امراته لحجة انها عاقر ويتزوج باخري للنسل ومن فعل ذلك فهو زاني بحكم الكتاب

.” And, “Whosoever shall marry her that is divorced from another husband, committeth adultery.”17861786    Matt. v. 28, 29, 32. But if the husband know that his wife has gone astray, and if the woman does not repent, but persists in her fornication, and yet the husband continues to live with her, he also is guilty of her crime, and a sharer in her adultery.” And I said to him, “What then, sir, is the husband to do, if his wife continue in her vicious practices?” And he said, “The husband should put her away, and remain by himself. But if he put his wife away and marry another, he also commits adultery.”167167    Matt. v. 32, xix. 9. And I said to him, “What if the woman put away should repent, and wish to return to her husband: shall she not be taken back by her husband?” And he said to me, “Assuredly. If the husband do not take her back, he sins, and brings a great sin upon himself; for he ought to take back the sinner who has repented. But not frequently

سؤال لو احد عنده زوجه ويثق بها في الرب ولكنه تاكد انها زنت هل يخطئ لو استمر معها ؟ فقال لي لو هو جاهل بخطيتها فهو لم يخطي لو عاش معها لكن لو عرف انها ضلت وهي لم تتوب ولكن اصرت علي خطاياها فلو استمر معها فهو مذنب في جريمتها ويشارك في زناها فسالت ماذا يفعل الزوج لو استمرت الزوجه في افعالها الشريره فقال يجب ان الزوج يضعها بعيدا ويبقي بنفسه فقط بدون زواج ولكنه لو وضعها جانبا وتزوج فهو يزني فسالت فماذا لو التي وضعت جانبا تابت فعلا وتمنت الرجوع الي زوجها هل لا تقبل بزوجها ؟ فقال الحق لو زوجها لم ياخذها فهو يخطئ ويجلب خطيه كبيره علي نفسه لانه رفض ان ياخذها كخاطئ تاب ولكن ليست لتصنع هذا باستمرار.

القديس ثاؤفيلوس

And he that marrieth,” says [the Gospel], “her that is divorced from her husband, committeth adultery; and whosoever putteth away his wife, saving for the cause of fornication, causeth her to commit adultery.”663663    Matt. v. 32.

ومتي قال في الانجيل التي التي طلقت زوجها زنت والذي يطلق زوجته ليس لعلة الزنا يجعلها تزني



القديس اكليمندوس الاسكندري

في مقالته عن الزواج وهي مقالة طويله ورائعه

Now that the Scripture counsels marriage, and allows no release from the union, is expressly contained in the law, “Thou shalt not put away thy wife, except for the cause of fornication;” and it regards as fornication, the marriage of those separated while the other is alive. Not to deck and adorn herself beyond what is becoming, renders a wife free of calumnious suspicion, while she devotes herself assiduously to prayers and supplications; avoiding frequent departures from the house, and shutting herself up as far as possible from the view of all not related to her, and deeming housekeeping of more consequence than impertinent trifling. “He that taketh a woman that has been put away,” it is said, “committeth adultery; and if one puts away his wife, he makes her an adulteress,”24312431    Matt. v. 32; xix. 9. that is, compels her to commit adultery.

والانجيل يشرح الزواج ويوضح انه لا فك من الارتباط فهو ناموس " لايجب ان يطلق زوجته الا لعلة الزنا ولكن بالزنا الزواج ( يقصد للطرف الغير زاني الاول ) حتي ولو كان الثاني حي . فلا يجب ان تدنس نفسها ولكن تخصص نفسها للتوبه بالصلاه والعباده وتتجنب ترك البيت باستمرار وتغلق علي نفسها علي قدر الامكان من من لا يقرب لها

والذي ياخذ مطلقه مكتوب انه يزني والذي يطلق زوجته يجعلها تزني فيما عدا لعلة الزني

And not only is he who puts her away guilty of this, but he who takes her, by giving to the woman the opportunity of sinning; for did he not take her, she would return to her husband. What, then, is the law?24322432    Lev. xx. 10; Deut. xxii. 22. In order to check the impetuosity of the passions, it commands the adulteress to be put to death, on being convicted of this; and if of priestly family, to be committed to the flames.24332433    Lev. xxi. 9. And the adulterer also is stoned to death, but not in the same place, that not even their death may be in common.

وليس فقط الذي يطلق زوجته يزني في هذا ولكن الذي يتزوجها ايضا لانه اعطاها فرصه لتزني لانه لم لم ياخذها لكانت رجعت لزوجها بعد توبتها وهو في الناموس لاوييين 20: 10 والتثنية 22: 22

يامر الزناه بان يقتلوا لارتكابهم ذلك وعائلتها لو اشتركت في ذلك تحرق لاويين 21: 9 والزاني يرجم للموت وليس في نفس المكان لكي لا يكون موتهم مشترك

فهو يشرح ان الزاني يعتبر ميت فهو يحي فقط حياة التوبه الا لو سامحه الطرف الاخر فيعتبر كما لو كان ميتا فعاش

وملخص كلامه ان الكتاب المقدس يمنع المفارقه تماما ولا يهجر رجل امراته لااي سبب مهما كان الا لعلة الزنا ويعتبر الانسان زاني لو تزوج مره اخري مادام الاخر علي قيد الحياه لانه مكتوب من تزوج بمطلقه يزني

Meantime withal, while prohibiting divorce, he uses the Lord’s precept against adultery as an instrument for providing, in place of divorce, either perseverance in widowhood, or else a reconciliation of peace:  inasmuch as “whoever shall have dismissed a wife (for any cause) except the cause of adultery, maketh her commit adultery; and he who marrieth one dismissed by a husband committeth adultery.”879879    Matt. v. 32.   What powerful remedies does the Holy Spirit furnish, to prevent, to wit, the commission anew of that which He wills not should anew be pardoned!

Now, if in all cases he says it is best for a man thus to be; “Thou art joined to a wife, seek not loosing” (that you may give no occasion to adultery); “thou art loosed from a wife, seek not a wife,” that you may reserve an opportunity for yourself:

to act contrary to the design of the teaching of the Saviour, every one would acknowledge to be impious.  I wonder therefore why He did not say, Let no one put away his own wife saving for the cause of fornication, but says, “Whosoever shall put away his own wife, saving for the cause of fornication, maketh her an adulteress.”62326232    Matt. v. 32.   For confessedly he who puts away his wife when she is not a fornicator, makes her an adulteress, so far as it lies with him, for if, “when the husband is living she shall be called an adulteress if she be joined to another man;”62336233    Rom. vii. 3. and when by putting her away, he gives to her the excuse of a second marriage, very plainly in this way he makes her an adulteress.



وايضا يقول

سماح بعض قادة كنائس بتزويج امراه باخر في حياة زوجها هو ضد الكتاب المقدس لانهم يخالفوا ان المراه مرتبطه بالرجل مادام حيا فان صارت لاخر تدعي زانيه

And in such wise it is said, “Two shall be in one flesh,”48754875    Matt. xix. 5. that what had been made one should return together, that a separation without return should not afford any occasion to a stranger. Thence also the apostle declares that the man is the head of the woman, that he might commend chastity in the conjunction of the two. For as the head cannot be suited to the limbs of another, so also one’s limbs cannot be suited to the head of another: for one’s head matches one’s limbs, and one’s limbs one’s head; and both of them are associated by a natural link in mutual concord, lest, by any discord arising from the separation of the members, the compact of the divine covenant should be broken. Yet he adds, and says: “Because he who loves his wife, loves himself. For no one hates his own flesh; but nourishes and cherishes it, even as Christ the Church.”48764876    Eph. v. 28, 29.   From this passage there is great authority for charity with chastity, if wives are to be loved by their husbands even as Christ loved the Church and wives ought so to love their husbands also as the Church loves Christ.

6. Christ gave this judgment when, being inquired of, He said that a wife must not be put away, save for the cause of adultery; such honour did He put upon chastity. Hence arose the decree: “Ye shall not suffer adulteresses to live.”48774877    Lev. xx. 10.   Hence the apostle says: “This is the will of God, that ye abstain from fornication.”48784878    1 Thess. iv. 3. Hence also he says the same thing: “That the members of Christ must not be joined with the members of an harlot.”48794879    1 Cor. vi. 15. Hence the man is delivered over unto Satan for the destruction of the flesh, who, treading under foot the law of chastity, practises the vices of the flesh. Hence with reason adulterers do not attain the kingdom of heaven. Hence it is that every sin is without the body, but that the adulterer alone sins against his own body. Hence other authoritative utterances of the instructor, all of which it is not necessary at this time to collect, especially among you, who for the most part know and do them; and you cannot find cause for complaint concerning these things, even though they are not described. For the adulterer has not an excuse, nor could he have, because he might take a wife.

ويشرح ايضا كثيرا ويؤكد المفهوم الكتابي ويقول ان الكتاب يقول ان الرجل راس المراه فلا يصلح ان ينفصل الراس عن الجسد ولا يركب راس جسد اخر ولا ينفصل الجسد ليلتحم براس اخر ومن يرتبط بمطلق او مطلقه فهو يرتبط بزاني او زانيه ويدنس جسد الرب لاننا اعضاء في جسد الرب فلا نجعلها اعضاء زانيه

لايجوز للرجل وزوجته حيه ان يتزوج بغيرها لانه ان فعل ذلك فهو زني حقيقي

الباباوات الذين نفذوا تعليم الإنجيل في موضوع الطلاق:


القديس تيموثاوس البطريرك 23

ان كان امراه مبتلاه بروح شريره وخطر علي زوجها ويقول الزوج انه لا يقدر ان يضبط نفسه فهل يطلقها ويتزوج بغيرها ؟ فاجاب وقال هذا امر فسق لو فعل ذلك وليس عندي امر اخر غير ذلك

الباب كيرلس الثالث (البطريرك 75) المتنيح سنة 1242.

فى أيامه عقد مجمع مقدس للقيام بالإصلاح، ووضع قوانين منها ما يختص بالزيجة. وقد حصرها في الزنا. وما يتبعه مثل أن يدبر الرجل على فساد عفة زوجته. وأعتبر الزواج منهياً برهبنة الزوجين برضاهما معاً.

الباب بطرس السادس (البطريرك 104) المتنيح سنة 1726:

ابطل الطلاق للأسباب المتعددة، غير السبب الواحد الذي ذكره الكتاب. وقد حدث مناقشة في ذلك مع علماء المسلمين. فكتبوا له الفتاوى بأن هذا هو تعليم ديانته، وليس لأحد عليه معارضة. وصدر له بذلك فرمان من الوالى.

الباب مكاريوس الثالث (البطريرك 114) المتنيح سنة 1945:

وقد عقد مجمعاً، عارض فيه الأسباب الكثيرة التي تبيح الطلاق. وهاجم لائحة 1938 التي سمحت بذلك. وتمسك بأنه لا طلاق إلا لعلة الزنا حسب تعليم الكتاب.




ثامنا
: إن القول بعدم زواج المطلق بسبب الزنى مدى الحياة يتنافى مع حقوق الإنسان وليس من المناسب القول إن مبادئ حقوق الإنسان أعلى من الوحى المقدس الذى جاء لأجل الإنسان كما عبر السيد المسيح قائلا إن السبت لأجل الإنسان وليس الإنسان لأجل السبت. أى إن الوصية فى خدمة الإنسان وإسعاده وليس العكس.
التمسك بحقوق الانسان لا يتماشي مع المثال الذي ذكرته سابقا عن قطع اللحم فلو تمسكت بان من حقك ان تقطع يدك فلا تقول بان من حقك كانسان ان تعيدها مره اخري او تقطع يد انسان اخر لتكون لك يد مره اخري

الباب الثاني: في قوانين الطلاق

الفصل الأول: في أسباب الطلاق

مادة 50: يجوز لكل من الزوجين أن يطلب الطلاق لعلة الزنا

مادة 51: إذا خرج أحد الزوجين عن الدين المسيحي وانقطع الأمل من رجوعه إليه جاز الطلاق بناء على طلب الزوج الآخر

مادة 52: إذا غاب أحد الزوجين خمس سنوات متوالية بحيث لا يعلم مقره ولا تعلم حياته من وفاته وصدر حكم بإثبات غيبته جاز الزوج الآخر أن يطلب الطلاق.

مادة 53: الحكم على أحد الزوجين بعقوبة الأشغال الشاقة أو السجن أو الحبس لمدة سبع سنوات فأكثر يسوغ للزوج طلب الطلاق.

مادة 54: إذا أصيب أحد الزوجين بجنون مطبق أو بمرض معد يخشى منه على سلامة الآخر يجوز للزوج الآخر أن يطلب الطلاق إذا كان قد مضى ثلاثة سنوات على الجنون أو المرض وثبت أنه غير قابل للشفاء، ويجوز أيضاً للزوجة أن تطلب الطلاق لإصابة زوجها بمرض العنة إذا مضىعلى إصابته ثلاثة سنوات وثبت أنه غير قابل للشفاء وكانت الزوجة في سن يخشى عليها من الفتنة.

مادة 55: إذا إعتدى أحد الزوجين على حياة الآخر وإعتاد إيذاءه إيذاءاً جسيماً يعرض صحته للخطر جاز للزوج المجني عليه أن يطلب الطلاق.

مادة 56: إذا ساء سلوك أحد الزوجين وفسدت أخلاقه وانغمس في حماة  الرذيلة ولم يجد في إصلاحه توبيخ الرئيس الديني ونصائحه ، فللزوج الآخر أن يطلب الطلاق.

مادة 57: يجوز أيضاً طلب الطلاق إذا أساء أحد الزوجين معاشرة الآخر أو أخل بواجباته نحوه اخلالاً جسيماً مما أدى إلى استحكام النفور بينهم وانتهى الأمر بافتراقهما عن بعضهما واستمرت الفرقة ثلاث سنين متوالية.

مادة 58: كذلك يجوز الطلاق إذا ترهبن الزوجان او ترهبن أحدهما.

الفصل الثاني: في إجراءات دعوى الطلاق

مادة 59: تقدم عريضة الدعوى من طالب الطلاق شخصياً إلى رئيس المجلس الملي الفرعي وإذا تعذر حضور الطالب بنفسه ينتقل الرئيس أو من ينتدبه من الأعضاء إلى محله. ووبعد أن يسمع الرئيس أو العضو المنتدب أقوال طالب الطلاق يعطيه مايقتضيه الحال من النصائح، فإن لم يقبلها يحدد للزوجين ميعاداً لا يقل عن ثمانية أيام كاملة للحضور أمامه بنفسيهما في مقر المجلس . فإذا تعذر لأحدهما الحضور أمامه يعين لهما المكان الذي يستطيعان الحضور فيه وفي اليوم المحدد يسمع أقوال الزوجين ويسعى في الصلح بينهما ، فإذا لم ينجح في مسعاه يأمر بإحالة الدعوى إلى المجلس ويحدد لها ميعاداً لا يتجاوز شهر

مادة 60: يبدأ المجلس قبل النظر في موضوع الدعوى بعرض الصلح على الزوجين. فإن لم يقبلاه ينظر في الترخيص لطالب الطلاق بأن يقيم بصفة مؤقته أثناء رفع الدعوى بمعزل عن الزوج الآخر مع تعيين المكان الذي تقيم فيه الزوجة إذا كانت هي طالبة الطلاق كما ينظر في تقرير نفقة لها على الزوج وفي حضانة الأولاد أثناء نظر الدعوى وفي تسليم الجهاز والأمتعة الخاصة. وحكم المجلس في هذه الأمور يكون مشمولاً بالنفاذ المؤقت من غير كفالة وقابلاً للإستئناف في ظرف ثمانية أيام من تاريخ صدوره.

مادة 61: يجوز لكل من الزوجين أن يوكل من يختاره من المحامين أو من أقاربه لغاية الدرجة الرابعة للمرافعة عنه إنما يلزم أن يكون حاضراً مع وكيله في الجلسة ما لم يمنعه مانع من الحضور.

مادة 62: تنظر الدعوى وتحقق بالطرق المعتادة

مادة 63: لا يؤخذ بإقرار المدعى عليه من الزوجين بما هو منسوب إليه مالم يكن مزيداً بالقرائن أو شهادة الشهود، ولا تعتبر القرابة أو أية صلة أخرى مانعه من الشهادة غير أنه لا يسوغ سماع شهادة أولاد الزوجين أو أولاد أولادهما.

مادة 64: لا تقبل دعوى الطلاق إذا حصل صلح بين الزوجين سواء بعد حدوث الوقائع المدعاة في الطلب أو بعد تقديم هذا الطلب ومع ذلك يجوز للطالب أن يرفع دعوى اخرى لسبب طرأ أو أكتشف بعد الصلح وله أن يستند إلى الأسباب القديمة في تأييد دعواه الجديدة.

مادة 65: تنقضى دعوى الطلاق بوفاة أحد الزوجين قبل صدور الحكم النهائي بالطلاق

مادة 66: يجوز الطعن في الأحكام الصادرة في دعاوى الطلاق بالطرق والأوضاع المقررة لغيرها من الدعاوى ولكن تقبل المعارضة في الحكم الغيابي في ظرف خمسة عشر يوماً من تاريخ إعلانه. ويجب أن تعرض دعاوى الطلاق على المجلس الملي العام ولو لم تستأنف أحكامها للنظر في التصديق على هذه الأحكام من عدمه. ولا ينفذ الحكم للقاضي بالطلاق إلا بعد صور الحكم النهائي به من المجلس الملي العام وبعد استنفاذ جميع طرق الطعن بما فيها الإلتماس.

مادة 67: يسجل الحكم النهائي القاضي بالطلاق في السجل المعد لذلك بدار البطريركية ويؤشر بمضمونه على أصل عقد الزواج بالسجل المحفوظ لدى الكاهن وعلى القسيمة المحفوظة لدى الرياسة الدينية وعلى القسيمة الموجودة لدى الزوج الذي صدر حكم الطلاق بناء على طلبه.

الفصل الثالث: في اجراءات دعوى الطلاق

مادة 68: يترتب على الطلاق إنحلال رابطة الزوجية من تاريخ الحكم النهائي الصادر به ، فتزول حقوق كل من الزوجين وواجباته قبل الآخر ولا يرث أحدهما الآخر عند موته.

مادة 69: يجوز لكل من الزوجين بعد الحكم بالطلاق أن يتزوج من شخص آخر إلا إذا نصر الحكم على حرمان أحدها أو كليهما من الزواج. وفي هذه الحالة لا يجوز لمن قضى بحرمانه أن يتزوج إلا بتصريح من المجلس.

Chapter XXIII.—On Marriage.

Since pleasure and lust seem to fall under marriage, it must also be treated of. Marriage is the first conjunction of man and woman for the procreation of legitimate children.24212421    [He places the essence of marriage in the chaste consummation itself, the first after lawful nuptials. Such is the force of this definition, which the note in ed. Migne misrepresents, as if it were a denial that second nuptials are marriage.] Accordingly Menander the comic poet says:—

For the begetting of legitimate children,

I give thee my daughter.”

We ask if we ought to marry; which is one of the points, which are said to be relative. For some must marry, and a man must be in some condition, and he must marry some one in some condition. For every one is not to marry, nor always. But there is a time in which it is suitable, and a person for whom it is suitable, and an age up to which it is suitable. Neither ought every one to take a wife, nor is it every woman one is to take, nor always, nor in every way, nor inconsiderately. But only he who is in certain circumstances, and such an one and at such time as is requisite, and for the sake of children, and one who is in every respect similar, and who does not by force or compulsion love the husband who loves her. Hence Abraham, regarding his wife as a sister, says, “She is my sister by my father, but not by my mother; and she became my wife,”24222422    Gen. xx. 12. teaching us that children of the same mothers ought not to enter into matrimony. Let us briefly follow the history. Plato ranks marriage among outward good things, providing for the perpetuity of our race, and handing down as a torch a certain perpetuity to children’s children. Democritus repudiates marriage and the procreation of children, on account of the many annoyances thence arising, and abstractions from more necessary things. Epicurus agrees, and those who place good in pleasure, and in the absence of trouble and pain. According to the opinion of the Stoics, marriage and the rearing of children are a thing indifferent; and according to the Peripatetics, a good. In a word, these, following out their dogmas in words, became enslaved to pleasures; some using concubines, some mistresses, and the most youths. And that wise quaternion in the garden with a mistress, honoured pleasure by their acts. Those, then, will not escape the curse of yoking an ass with an ox, who, judging certain things not to suit them, command others to do them, or the reverse. This Scripture has briefly showed, when it says, “What thou hatest, thou shalt not do to another.”24232423    Tob. iv. 15.

But they who approve of marriage say, Nature has adapted us for marriage, as is evident from the structure of our bodies, which are male and female. And they constantly proclaim that command, “Increase and replenish.”24242424    Gen. i. 28. And though this is the case, yet it seems to them shameful that man, created by God, should be more licentious than the irrational creatures, which do not mix with many licentiously, but with one of the same species, such as pigeons and ringdoves,24252425    [The offering of the purification has a beautiful regard to the example of the turtle-dove; and the marriage-ring may have been suggested by the ringdove, a symbol of constancy in nature.] and creatures like them. Furthermore, they say, “The childless man fails in the perfection which is according to nature, not having substituted his proper successor in his place. For he is perfect that has produced from himself his like, or rather, when he sees that he has produced the same; that is, when that which is begotten attains to the same nature with him who begat.” Therefore we must by all means marry, both for our country’s sake, 378for the succession of children, and as far as we are concerned, the perfection of the world; since the poets also pity a marriage half-perfect and childless, but pronounce the fruitful one happy. But it is the diseases of the body that principally show marriage to be necessary. For a wife’s care and the assiduity of her constancy appear to exceed the endurance of all other relations and friends, as much as to excel them in sympathy; and most of all, she takes kindly to patient watching. And in truth, according to Scripture, she is a needful help.24262426    Gen. ii. 18. [A beautiful tribute to the true wife.] The comic poet then, Menander, while running down marriage, and yet alleging on the other side its advantages, replies to one who had said:—

I am averse to the thing,

For you take it awkwardly.”

Then he adds:—

You see the hardships and the things which annoy you in it.

But you do not look on the advantages.”

And so forth.

Now marriage is a help in the case of those advanced in years, by furnishing a spouse to take care of one, and by rearing children of her to nourish one’s old age.

For to a man after death his children bring renown,

Just as corks bear the net,

Saving the fishing-line from the deep.”24272427    The corrections of Stanley on these lines have been adopted. They occur in the Choephoræ of Æschylus, 503, but may have been found in Sophocles, as the tragic poets borrowed from one another.

Legislators, moreover, do not allow those who are unmarried to discharge the highest magisterial offices. For instance, the legislator of the Spartans imposed a fine not on bachelorhood only, but on monogamy,24282428    i.e., not entering into a second marriage after a wife’s death. But instead of μονογαμίου some read κακογαμίου—bad marriage. and late marriage, and single life. And the renowned Plato orders the man who has not married to pay a wife’s maintenance into the public treasury, and to give to the magistrates a suitable sum of money as expenses. For if they shall not beget children, not having married, they produce, as far as in them lies, a scarcity of men, and dissolve states and the world that is composed of them, impiously doing away with divine generation. It is also unmanly and weak to shun living with a wife and children. For of that of which the loss is an evil, the possession is by all means a good; and this is the case with the rest of things. But the loss of children is, they say, among the chiefest evils: the possession of children is consequently a good thing; and if it be so, so also is marriage. It is said:—

Without a father there never could be a child,

And without a mother conception of a child could not be.

Marriage makes a father, as a husband a mother.”24292429    [To be a mother, indeed, one must be first a wife; the woman who has a child out of wedlock is not entitled to this holy name.]

Accordingly Homer makes a thing to be earnestly prayed for:—

A husband and a house;”

yet not simply, but along with good agreement. For the marriage of other people is an agreement for indulgence; but that of philosophers leads to that agreement which is in accordance with reason, bidding wives adorn themselves not in outward appearance, but in character; and enjoining husbands not to treat their wedded wives as mistresses, making corporeal wantonness their aim; but to take advantage of marriage for help in the whole of life, and for the best self-restraint.

Far more excellent, in my opinion, than the seeds of wheat and barley that are sown at appropriate seasons, is man that is sown, for whom all things grow; and those seeds temperate husbandmen ever sow. Every foul and polluting practice must therefore be purged away from marriage; that the intercourse of the irrational animals may not be cast in our teeth, as more accordant with nature than human conjunction in procreation. Some of these, it must be granted, desist at the time in which they are directed, leaving creation to the working of Providence.

By the tragedians, Polyxena, though being murdered, is described nevertheless as having, when dying, taken great care to fall decently,—

Concealing what ought to be hid from the eyes of men.”

Marriage to her was a calamity. To be subjected, then, to the passions, and to yield to them, is the extremest slavery; as to keep them in subjection is the only liberty. The divine Scripture accordingly says, that those who have transgressed the commandments are sold to strangers, that is, to sins alien to nature, till they return and repent. Marriage, then, as a sacred image, must be kept pure from those things which defile it.24302430    [A holy marriage, as here so beautifully defined, was something wholly unknown to Roman and Greek civilization. Here we find the Christian family established.] We are to rise from our slumbers with the Lord, and retire to sleep with thanksgiving and prayer,—

Both when you sleep, and when the holy light comes,”

confessing the Lord in our whole life; possessing piety in the soul, and extending self-control to the body. For it is pleasing to God to lead decorum from the tongue to our actions. Filthy speech is the way to effrontery; and the end of both is filthy conduct.

Now that the Scripture counsels marriage, and allows no release from the union, is expressly contained in the law, “Thou shalt not put away thy wife, except for the cause of fornication;” and it regards as fornication, the marriage of those separated while the other is alive. Not to deck and adorn herself beyond what is becoming, renders a wife free of calumnious suspicion, while she devotes herself assiduously to prayers and supplications; avoiding frequent departures from the house, and shutting herself up as far as possible from the view of all not related to her, and deeming housekeeping of more consequence than impertinent trifling. “He that taketh a woman that has been put away,” it is said, “committeth adultery; and if one puts away his wife, he makes her an adulteress,”24312431    Matt. v. 32; xix. 9. that is, compels her to commit adultery. And not only is he who puts her away guilty of this, but he who takes her, by giving to the woman the opportunity of sinning; for did he not take her, she would return to her husband. What, then, is the law?24322432    Lev. xx. 10; Deut. xxii. 22. In order to check the impetuosity of the passions, it commands the adulteress to be put to death, on being convicted of this; and if of priestly family, to be committed to the flames.24332433    Lev. xxi. 9. And the adulterer also is stoned to death, but not in the same place, that not even their death may be in common. And the law is not at variance with the Gospel, but agrees with it. How should it be otherwise, one Lord being the author of both? She who has committed fornication liveth in sin, and is dead to the commandments; but she who has repented, being as it were born again by the change in her life, has a regeneration of life; the old harlot being dead, and she who has been regenerated by repentance having come back again to life. The Spirit testifies to what has been said by Ezekiel, declaring, “I desire not the death of the sinner, but that he should turn.”24342434    Ezek. xxxiii. 11. Now they are stoned to death; as through hardness of heart dead to the law which they believed not. But in the case of a priestess the punishment is increased, because “to whom much is given, from him shall more be required.”24352435    Luke. xii. 48.

Chapter XXXIV.—Moses, Allowing Divorce, and Christ Prohibiting It, Explained. John Baptist and Herod. Marcion’s Attempt to Discover an Antithesis in the Parable of the Rich Man and the Poor Man in Hades Confuted. The Creator’s Appointment Manifested in Both States.

But Christ prohibits divorce, saying, “Whosoever putteth away his wife, and marrieth another, committeth adultery; and whosoever marrieth her that is put away from her husband, also committeth adultery.”48034803    Luke xvi. 18. In order to forbid divorce, He makes it unlawful to marry a woman that has been put away. Moses, however, permitted repudiation in Deuteronomy: “When a man hath taken a wife, and hath lived with her, and it come to pass that she find no favour in his eyes, because he hath found unchastity in her; then let him write her a bill of divorcement and give it in her hand, and send her away out of his house.”48044804    Deut. xxiv. 1. You see, therefore, that there is a difference between the law and the gospel—between Moses and Christ?48054805    A Marcionite challenge. To be sure there is!48064806    Plane. But then you have rejected that other gospel which witnesses to the same verity and the same Christ.48074807    St. Matthew’s Gospel. There, while prohibiting divorce, He has given us a solution of this special question respecting it: “Moses,” says He, “because of the hardness of your hearts, suffered you to give a bill of divorcement; but from the beginning it was not so”48084808    Matt. xix. 8. —for this reason, indeed, because He who had “made them male and female” had likewise said, “They twain shall become one flesh; what therefore God hath joined together, let not man put asunder.”48094809    Matt. xix. 4, 6. For in the Gospel of Matthew he says, “Whosoever shall put away his wife, saving for the cause of fornication, causeth her to commit adultery.”48264826    Matt. v. 32. He also is deemed equally guilty of adultery, who marries a woman put away by her husband.  The Creator, however, except on account of adultery, does not put asunder what He Himself joined together, the same Moses in another passage enacting that he who had married after violence to a damsel, should thenceforth not have it in his power to put away his wife.48274827    Deut. xxii. 28, 29. Now, if a compulsory marriage contracted after violence shall be permanent, how much rather shall a voluntary one, the result of agreement! This has the sanction of the prophet: “Thou shalt not forsake the wife of thy youth.”48284828    Mal. ii. 15. Thus you have Christ following spontaneously the tracks of the Creator everywhere, both in permitting divorce and in forbidding it. You find Him also protecting marriage, in whatever direction you try to escape. He prohibits divorce when He will have the marriage inviolable; He permits divorce when the marriage is spotted with unfaithfulness. You should blush when you refuse to unite those whom even your Christ has united; and repeat the blush when you disunite them without the good reason why your Christ would have them separated. This he said in order the more severely to load Herod with guilt, who had taken his brother’s wife, after she had been loosed from her husband not less by death than by divorce; who had been impelled 406thereto by his lust, not by the prescription of the (Levirate) law—for, as his brother had left a daughter, the marriage with the widow could not be lawful on that very account;48364836    The condition being that the deceased brother should have left “no child” see (Deut. xxv. 5). and who, when the prophet asserted against him the law, had therefore put him to death. Our answer to this is, that the Scripture itself which dazzles48444844    Revincente: perhaps “reproves his eyesight,” in the sense of refutation. his sight expressly distinguishes between Abraham’s bosom, where the poor man dwells, and the infernal place of torment.  “Hell” (I take it) means one thing, and “Abraham’s bosom” another. “A great gulf” is said to separate those regions, and to hinder a passage from one to the other. Besides, the rich man could not have “lifted up his eyes,”48454845    Luke xvi. 23. and from a distance too, except to a superior height, and from the said distance all up through the vast immensity of height and depth. It must therefore be evident to every man of intelligence who has ever heard of the Elysian fields, that there is some determinate place called Abraham’s bosom, and that it is designed for the reception of the souls of Abraham’s children, even from among the Gentiles (since he is “the father of many nations,” which must be classed amongst his family), and of the same faith as that wherewithal he himself believed God, without the yoke of the law and the sign of circumcision. This region, therefore, I call Abraham’s bosom. Although it is not in heaven, it is yet higher than hell,48464846    Sublimiorem inferis. [Elucidation VIII.] and is appointed to afford an interval of rest to the souls of the righteous, until the consummation of all things shall complete the resurrection of all men with the “full recompense of their reward.”48474847    Compare Heb. ii. 2 with x. 35 and xi. 26. This consummation will then be manifested in heavenly promises, which Marcion, however, claims for his own god, just as if the Creator had never announced them.  Amos, however, tells us of “those stories towards heaven”48484848    Ascensum in cœlum: Sept. ἀνάβασιν εἰς τὸν οὐρανόν, Amos ix. 6. See on this passage the article Heaven in Kitto’s Cyclopædia (3d edit.), vol. ii. p. 245, where the present writer has discussed the probable meaning of the verse. which Christ “builds”—of course for His people.  There also is that everlasting abode of which Isaiah asks, “Who shall declare unto you the eternal place, but He (that is, of course, Christ) who walketh in righteousness, speaketh of the straight path, hateth injustice and iniquity?”48494849    Isa. xxxiii. 14–16, according to the Septuagint, which has but slight resemblance to the Hebrew. Now, although this everlasting abode is promised, and the ascending stories (or steps) to heaven are built by the Creator, who further promises that the seed of Abraham shall be even as the stars of heaven, by virtue certainly of the heavenly promise, why may it not be possible,48504850    Cur non capiat. without any injury to that promise, that by Abraham’s bosom is meant some temporary receptacle of faithful souls, wherein is even now delineated an image of the future, and where is given some foresight of the glory48514851    Candida quædam prospiciatur: where candida is a noun substantive (see above, chap. vii. p. 353). of both judgments? If so, you have here, O heretics, during your present lifetime, a warning that Moses and the prophets declare one only God, the Creator, and His only Christ, and how that both awards of everlasting punishment and eternal salvation rest with Him, the one only God, who kills and who makes alive.  Well, but the admonition, says Marcion, of our God from heaven has commanded us not to hear Moses and the prophets, but Christ; Hear Him is the command.48524852    There seems to be here an allusion to Luke ix. 35. This is true enough. For the apostles had by that time sufficiently heard Moses and the prophets, for they had followed Christ, being persuaded by Moses and the prophets. For even Peter would not have been able48534853    Nec accepisset. to say, “Thou art the Christ,”48544854    Luke ix. 20. unless he had beforehand heard and believed Moses and the prophets, by whom alone Christ had been hitherto announced.  Their faith, indeed, had deserved this confirmation by such a voice from heaven as should bid them hear 407Him, whom they had recognized as preaching peace, announcing glad tidings, promising an everlasting abode, building for them steps upwards into heaven.48554855    See Isa. lii. 7, xxxiii. 14 (Sept.), and Amos ix. 6.
